By Justin Wise (February 17, 2022, 4:51 PM EST) — The former Perkins Coie LLP partner charged with lying to the FBI asked a D.C. federal court Thursday to toss the case, claiming that the indictment represents “extraordinary prosecutorial overreach” and that allowing a trial to go forward risks criminalizing ordinary conduct.
Michael Sussmann asked the court to dismiss the one-count indictment from special counsel John Durham for failure to state an offense. Insisting that he did not lie to the FBI, he argued that the alleged crime of making a materially false statement fails to pass muster since there’s no evidence his remarks influenced the agency’s decision-making.
